4.1 Introductory provisions
These Terms of Use set out the conditions for accessing and using the website https://imp-pro-mont.si/en/ (the "website"). By using the website, the user confirms that they have read and accept these Terms.

4.3 Availability and use of the website
The website is generally available 24 hours a day. The operator reserves the right to temporary unavailability for technical reasons, maintenance or upgrades.
The user undertakes to use the website lawfully and in a manner that does not interfere with the rights of the operator or third parties.
4.4 Content and limitation of liability
The content of the website is informative and serves to present the company, its fields of work and completed projects. The operator makes every effort to keep the information accurate and up to date but accepts no liability for any errors, omissions or outdated information.
The content of the website does not constitute an offer and is not binding on the operator. It is to be regarded as an invitation to enquire. Only a written document issued and signed by an authorised representative of the company is binding, to the extent defined therein.
Technical data, dimensions, capacities and descriptions of solutions are illustrative and refer to completed cases. In a specific project they depend on the client's requirements, process parameters and applicable legislation. The operator reserves the right to make changes without prior notice.
References to standards, guidelines and qualification requirements describe the company's competence and practice. They do not constitute a warranty that any given execution will automatically comply with the requirements of a specific client or regulator; the scope of compliance is defined in the contractual documentation of each project.
Project descriptions are published only to the extent that they do not disclose clients' confidential information. Naming a client or a project does not constitute a warranty that the same result will be achieved in another project.
Information on the website does not constitute technical, legal or investment advice, unless expressly stated within a contractual relationship.
4.5 Copyright
All content on the website — texts, photographs, diagrams, technical drawings, videos, downloadable documents, the structure of the site and its source code — is protected by copyright and belongs to the operator or its partners.
Without the operator's prior written consent, the following is prohibited:
- reproduction, distribution or other use of the content for commercial purposes
- use of technical diagrams, descriptions of solutions or reference descriptions as a basis for one's own offers or project solutions

Viewing the website, printing or saving individual content for personal non-commercial use, and quoting short extracts with attribution to the source, are permitted.
4.6 Content submitted by the user
The user is responsible for the accuracy of the data they submit via the contact form or by e-mail.
Please do not send trade secrets or confidential technical documentation through the web form. For the exchange of such documents we will agree on a secure channel and, where necessary, conclude a non-disclosure agreement.

4.10 Governing law and jurisdiction
These Terms of Use are governed by the law of the Republic of Slovenia. Any disputes shall be settled by the court with subject-matter jurisdiction in Slovenia.

5.1 Data controller

The controller processes personal data in accordance with Regulation (EU) 2016/679 (GDPR), the Slovenian Personal Data Protection Act (ZVOP-2), the Electronic Communications Act (ZEKom-2) and other applicable legislation.
5.2 Categories of personal data
The controller may process the following personal data:
- basic identification data (first name, surname)
- contact details (e-mail address, telephone number)
- company details (company name, job title)
- data submitted through contact forms and enquiries
- data for newsletter purposes, including a record of the consent given
- technical data about the visit (IP address, browser and device data, pages visited, time of visit).
5.3 Purposes of processing
We process personal data in order to:
- respond to enquiries and communicate with clients
- prepare offers and deliver services
- send newsletters and information about content and events
- improve the functioning of the website and the user experience
- ensure the security of the website and prevent misuse
- comply with legal obligations.
5.4 Legal basis for processing
- consent of the individual (newsletter subscription, non-essential cookies)
- performance of a contract or steps taken prior to entering into a contract (enquiries, offers, project delivery)
- legitimate interests of the controller (website security, establishment or defence of legal claims, informing existing clients about related services)
- legal obligations (tax and accounting legislation).
5.5 Retention of personal data
We retain personal data only for as long as necessary for the purpose of processing:
- enquiry data: 3 years from the last communication if no business relationship follows
- contract data: 5 years after fulfilment of the contract
- newsletter data: until consent is withdrawn
- technical visit data and server logs: 6 months
- accounting data: as required by legislation
- records of consent: 2 years after the consent ceases to apply.
Once the retention period expires, we delete the data or irreversibly anonymise it.
5.6 Disclosure of personal data
We do not sell personal data and do not disclose it to third parties for their own purposes. We may disclose it to:
- contracted processors (website hosting and maintenance, web analytics, newsletter tool, IT support, accounting services)
- competent authorities where required by law.
The controller has concluded appropriate data processing agreements with all processors. A list of specific processors is available on request at info@imp-pro-mont.si.
We use Google Analytics for web analytics. Data may therefore also be processed outside the European Economic Area, on the basis of a European Commission adequacy decision or Standard Contractual Clauses.
5.7 Your rights
In relation to your personal data, you have:
- the right of access
- the right to rectification
- the right to erasure (the right to be forgotten)
- the right to restriction of processing
- the right to data portability
- the right to object, including to processing for direct marketing purposes
- the right to withdraw consent, without affecting the lawfulness of processing carried out before withdrawal.
Requests can be sent to info@imp-pro-mont.si. We will respond within one month of receipt at the latest.
If you believe your rights have been infringed, you may lodge a complaint with the Information Commissioner of the Republic of Slovenia (www.ip-rs.si).
5.8 Newsletters and direct marketing
You can subscribe to our newsletter through the form on the website. You confirm your subscription by clicking the link in the confirmation e-mail.
You may withdraw your consent at any time — by clicking the unsubscribe link in any message or by writing to info@imp-pro-mont.si.
We may send existing clients information about services related to those we have delivered for them, without separate consent. You may object to these messages at any time as well.
5.9 Cookies
The website uses cookies for its operation, for analytics and to improve the user experience. Details are set out in the About Cookies section.
5.10 Data security
The controller applies appropriate technical and organisational measures to protect personal data, including encrypted data transmission, access control, regular backups and confidentiality undertakings by employees.
5.11 Automated decision-making
We do not take decisions based solely on automated processing of data collected through the website that would produce legal or similarly significant effects on an individual.
5.12 Changes to the Privacy Policy
The controller reserves the right to amend this Privacy Policy. Changes will be published on the website.
